Release of Liability, Assumption of Risk, and Agreement Not to Sue

PLEASE READ CAREFULLY. THIS IS A LEGAL DOCUMENT.

BY ENTERING THE PROPERTY, ATTENDING AN EVENT, CAMPING, OR SIGNING OR ELECTRONICALLY ACCEPTING THIS AGREEMENT, YOU ARE GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO BRING CERTAIN CLAIMS AGAINST THE PROPERTY OWNERS, EVENT ORGANIZERS, THEIR FAMILY MEMBERS, STAFF, VOLUNTEERS, CONTRACTORS, VENDORS, PERFORMERS, AND AGENTS.

This Agreement applies to every person entering or remaining upon the private property known as SoundLand, including attendees, campers, volunteers, vendors, performers, contractors, and guests participating in any activity conducted on the property.

For purposes of this Agreement, the Released Parties include the owners of SoundLand, event organizers, family members, volunteers, employees, contractors, vendors, performers, sponsors, and agents.

Acknowledgment

I understand this event takes place on privately owned rural property and not at a commercial concert venue.

I voluntarily choose to enter the property, attend the event, camp, park a vehicle, and participate in activities occurring during my visit.

I understand that outdoor events involve inherent risks that cannot be completely eliminated.

Assumption of Risk

I knowingly and voluntarily assume all ordinary risks associated with entering the property, including but not limited to:

Property Conditions

• Uneven ground

• Tree roots

• Rocks

• Gravel

• Dirt roads

• Slopes

• Holes

• Mud

• Grass

• Natural vegetation

• Fallen branches

• Low tree limbs

• Limited lighting outside designated event areas

• Wet or slippery conditions caused by weather

Natural Environment

The property contains wooded areas and natural surroundings.

Participants may encounter insects, bees, wasps, spiders, ticks, birds, rodents, and other naturally occurring wildlife.

Live Music Event

Risks include:

• Loud music

• High sound levels

• Stage lighting

• Flashing or strobe lighting

• Smoke or atmospheric effects (if used)

• Crowds

• Dancing

• Outdoor walking hazards

Individuals with hearing sensitivity, epilepsy, migraines, heart conditions, or similar medical concerns are responsible for taking appropriate precautions.

Stage and Production Equipment

The property contains:

• Stage

• Speakers

• Lighting equipment

• Electrical equipment

• Generators

• Power distribution equipment

• Audio equipment

• Electrical cables

Some public walkways use cable covers. Other cables may exist within restricted production areas.

Backstage, generator, lighting, electrical, and production areas are hazardous and strictly off limits except to authorized personnel.

Vehicles and Equipment

The property contains tractors, lawn equipment, trailers, maintenance equipment, utility vehicles, and tools.

Participants shall not climb on, operate, or interfere with any machinery or equipment.

Camping

Camping is at each participant's own risk.

Participants are responsible for selecting a safe campsite and securing their own belongings.

Fire

One designated communal campfire area has been provided.

It is enclosed with brick and surrounded by gravel.

No wood fires, charcoal fires, brush fires, or open fires are permitted anywhere else on the property without express permission.

Participants using propane stoves, camp stoves, propane grills, propane heaters, propane fire pits, or similar equipment are solely responsible for their safe operation, placement, supervision, fuel handling, and compliance with any fire restrictions.

Participants are responsible for any damage caused by equipment they bring onto the property.

Parking

Vehicles may park on dirt, gravel, grass, or uneven ground.

Participants assume all risks associated with parking, driving, loading, unloading, and walking through parking areas.

Domestic Animals

Domestic animals may be present on the property.

Participants should not approach or interact with any animal unless invited by its owner.

Weather

Participants assume risks associated with rain, wind, heat, cold, smoke, darkness, changing weather, and falling branches during storms.

Other Participants

The organizers cannot guarantee the conduct of every attendee.

Participants accept the ordinary risks associated with attending events involving other members of the public.

Restricted Areas

Unless specifically authorized, participants shall not enter:

• Residence

• Front yard surrounding the residence

• Barn

• Well house

• Storage buildings

• Maintenance buildings

• Equipment sheds

• Backstage

• Generator areas

• Production areas

• Electrical equipment

• Equipment trailers

• Machinery storage areas

• Any fenced, roped, signed, or otherwise restricted area

Participants shall obey all posted signs and directions given by event staff.

Participant Responsibilities

Participants agree to:

• Follow all Event Rules

• Stay within designated event areas

• Supervise children at all times

• Respect other guests

• Respect neighboring properties

• Report unsafe conditions to event staff

• Avoid restricted areas

• Properly extinguish cooking equipment

• Leave campsites reasonably clean

Participants are responsible for their own personal property.

Medical Care

Medical services may not be immediately available due to the rural location.

Participants are responsible for their own medical expenses.

If I become injured or unable to communicate, I authorize emergency medical treatment if deemed appropriate, understanding that all resulting costs remain my responsibility.

Release of Liability

To the fullest extent permitted by Washington law, I knowingly and voluntarily release, waive, discharge, and agree not to sue the Released Parties for claims arising from ordinary negligence relating to my attendance at the event or presence on the property.

This release does not apply where prohibited by law, including claims involving gross negligence, reckless conduct, or intentional misconduct.

Property Damage

I accept responsibility for damage caused by my actions, those of my guests, my minor children, or animals under my control.

Photography

I grant permission for photographs, video recordings, and audio recordings of me taken during the event to be used for promotional, archival, website, and social media purposes without compensation.

Removal From Property

The organizers reserve the right to refuse admission or require any participant to leave the property for unsafe behavior, illegal activity, entering restricted areas, threatening others, violating Event Rules, or creating unreasonable hazards.

Removal does not entitle a participant to a refund.

Governing Law

This Agreement shall be governed by the laws of the State of Washington.

If any provision is found unenforceable, the remaining provisions shall remain in effect.

Acknowledgment

I have carefully read this Release of Liability, Assumption of Risk, and Agreement Not to Sue.

I understand I am giving up certain legal rights.

I voluntarily accept the ordinary risks of attending an outdoor event held on private rural property.
